 NYS Dentistry Law:
Strategies for Compliance

There are a myriad of laws and regulations that govern the practice of our chosen profession. Learn about these rules and regulations and defensive strategies to keep you well within the safe harbor of compliance.

Issue to be examined include: delegation of professional responsibilities, expanded duty qualifications, certified dental assisting, scope of practice rules, record keeping, patient transfer, statute of limitations, advertising, fee-splitting, protection of confidential information, patient dismissal vs. abandonment, requirements for a dentist practicing orthodontics, who can take x-rays, unprofessional conduct, license and registrations requirements.

The Office of Professional Discipline is not the enemy, but sometimes it acts like it. Learn what you need to know to avoid running afoul of this powerful and often unchecked agency. We will discuss the steps every dentist should take to avoid having OPD visit, as well as what to do if OPD knocks.

Guest Faculty:
Eric Ploumis, DMD, JD is an attorney, an orthodontist, and an associate clinical professor at New York University. He limits his legal practice to business and transactional issues related to the practice of dentistry including practice transitions, partnership and employment agreements, office leases and the defense of allegations of professional misconduct.
New Section added:

Dealing with Complaints/Reducing Likelihood of Lawsuits

Review steps you should take to avoid employment claims, such as discrimination and harassment claims, as well as wage and hour disputes. You will also learn procedures you should follow when confronting difficult and often personally challenging employment decisions affecting you practice. We will review in detail the process and procedures that should be followed once a dentist is presented with a formal complaint or charge of discrimination or harassment.
